Trump Seeks Dismissal of Document Case Alleging Evidence Tampering

 June 13, 2024

Former President Donald Trump filed a motion to dismiss the classified documents case in Florida, alleging the FBI destroyed exculpatory evidence during the 2022 raid on his Mar-a-Lago residence.

According to the Washington Examiner, Trump’s attorneys, Todd Blanche and Chris Kise, argue that the FBI mishandled documents that impeded Trump's ability to mount a full defense. They claim the FBI failed to preserve the original order of the documents, and no photographs or logs document how the allegedly classified documents were mixed with personal items.

Trump’s motion also criticizes the conduct of special counsel Jack Smith’s office, accusing it of political animus and bad faith. His defense team asserts that evidence mishandling has hindered their ability to fully defend Trump. The allegations stem from the August 8, 2022, raid at Mar-a-Lago, where 39 boxes of documents were seized.

Allegations of Evidence Tampering by the FBI

Trump spokesman Steven Cheung released a statement emphasizing the gravity of the allegations. He said, “Trump had moved to dismiss the ‘documents hoax due to DOJ evidence tampering.’” Trump’s attorneys further claimed that the documents in the boxes were not in the same order as when they were seized because the FBI’s filter team made no effort to preserve the documents' original condition.

In a public filing, the special counsel’s office acknowledged inconsistencies with their previous representations about the condition of the evidence. “There are some boxes where the order of items within that box is not the same as in the associated scans,” the office stated. This acknowledgment has fueled Trump's claims of improper procedures and misconduct.

The defense argues that the prosecution’s actions delayed the provision of crucial information and failed to meet discovery obligations. Last month, Smith’s office admitted that some evidence was not in the same condition as found, further complicating the case.

Defense Criticizes Special Counsel's Conduct

Trump’s motion questions the integrity of the special counsel’s office and the FBI under the Biden Justice Department. It alleges that the prosecution has shown political animus and bad faith throughout the process. The defense claims that the mishandling of evidence by the FBI has prevented them from presenting a complete defense.

In another significant development, Judge Aileen Cannon ordered one paragraph to be stricken from the indictment. This paragraph detailed an incident where Trump allegedly showed a sensitive military map to an aide. Despite this minor victory, the motion to dismiss other charges was denied.

Steven Cheung reiterated Trump’s stance, stating, “Deranged Jack Smith was forced to admit in a public filing that he and his Thugs committed blatant evidence tampering by mishandling the very documents they used as pretext to bring this fake case.” This statement encapsulates Trump’s argument that the charges are politically motivated.

Impact of Evidence Handling on the Case

Trump’s defense argues that the improper handling of evidence has significantly impacted their ability to defend against the charges. They claim the lack of proper documentation and the disarray of the documents seized from Mar-a-Lago have compounded the challenges they face. The motion emphasizes that the prosecution's alleged misconduct has compromised the fairness of the trial.

The defense’s motion highlights a broader critique of the Biden administration’s handling of the case. They argue that the actions taken by the special counsel’s office and the FBI reflect a pattern of political bias. The motion seeks to dismiss the case entirely on these grounds.

Special counsel Jack Smith’s office responded to these allegations, stating, “The defendant has failed to provide factual or legal support for a spoliation claim under controlling Eleventh Circuit and Supreme Court case law. The government has met and exceeded its discovery and other legal obligations. The defendant’s misconduct allegations are, once again, false.”

Summary and Next Steps in the Case

Trump’s motion to dismiss the classified documents case in Florida is based on allegations of evidence tampering by the FBI during the 2022 Mar-a-Lago raid. The defense claims that this misconduct violated Trump’s due process rights and hindered their ability to mount a full defense. Judge Aileen Cannon’s recent rulings have addressed some aspects of the case, but the motion to dismiss several charges was denied. The special counsel’s office has acknowledged some inconsistencies in their handling of the evidence but maintains that Trump’s allegations are unfounded.
