Supreme Court Denies Trump Attorney Appeal

 October 3, 2023

Trump attorney John Eastman was dealt a legal loss by the Supreme Court on Monday.

The Court denied his petition to have a lower court case reviewed.

Supreme Court Justice Clarence Thomas recused himself from the case.

Talking Points…

  • Eastman's filing
  • Thomas recusal
  • My Two Cents…

Eastman's Filing

Eastman had been trying to protect emails from the January 6 House Select Committee that Pelosi has put together.

Eastman had lost the case at every level before looking to the Supreme Court for some relief.

The emails allegedly showed that Eastman knew certain aspects of the election being "stolen" that had been pushed by Trump were not accurate.

Eastman was also one of the power brokers behind the idea of having Mike Pence put an alternate slate of electors in play, a plan that never came to fruition because Pence refused to be a part of the effort.

The Court denied Eastman his day before the Supreme Court, which will keep the lower court ruling in place.

The Court also noted:

"Thomas took no part in the consideration or decision of this petition."

Thomas Recusal

Justice Thomas' recusal here was a no-brainer, but it still surprised quite a few people.

Eastman is a former clerk for Thomas, as well as being one of about 100 ex-clerks that vouched for Thomas after the hit pieces against him came out, and Democrats were demanding he resign from the bench.

This is the first time I can ever remember Thomas recusing himself from a case like this.

My Two Cents…

This denial by the court was not exactly a surprise, as the Supreme Court has gone out of its way to stay out of this election mess unless it was a real constitutional issue that had come about.

I think everyone is just looking forward to putting the 2020 election behind them and moving on at this point.

Trump has taken significant losses in the courtroom on this front, not winning a single case. For that matter, Kari Lake, who used Trump's game plan for her loss in 2022, has also lost every case she filed to try to overturn the 2022 Arizona gubernatorial election.

Even so, both of them continue to try to sway public opinion that their respective elections were stolen, but I think people are fatigued by that narrative right now.

With everything that is happening in this country, people want solutions, not whining, so it is more or less only Trump's base that is still interested in this.

Trump will never let this go, however, and Democrats know it, so if he wins the nomination, you better believe they will constantly poke the bear on this to get him to go off on this rather than the real issues voters are concerned about.
