The subpoena, issued to Authentic Campaigns CEO Michael Nellis, comes after what Jordan describes as a failure to comply with previous requests for information. The move is part of a broader Republican effort to scrutinize the impartiality of Judge Merchan, who has refused to recuse himself from the case despite alleged conflicts of interest and biases.

Jordan's Concerns Over Judicial Impartiality

In his letter to Nellis, Jordan expressed deep concern about the impartiality of Judge Merchan in light of his daughter's professional connections. Loren Merchan, the judge's daughter, serves as the president and a minority partner of Authentic Campaigns, a firm with close ties to prominent Democrats.

Jordan highlighted the company's work for Rep. Adam Schiff, who led Trump's first impeachment trial, and the Senate Majority PAC, a major Democratic fundraising organization. The Ohio Representative argued that these connections raise questions about potential conflicts of interest in the Trump case.

The subpoena demands that Nellis sit for a deposition and provide a sworn affidavit confirming that Authentic Campaigns never communicated with Judge Merchan. This request underscores the seriousness with which Jordan and his committee are approaching the issue of judicial impartiality in high-profile political cases.

Authentic Campaigns' Political Connections

Jordan's letter to Nellis delved into the specifics of Authentic Campaigns' work for Democratic politicians, including President Biden and Vice President Harris. The congressman noted that during Loren Merchan's employment with the Harris campaign, Authentic Campaigns received over $7 million in compensation for its services.

Furthermore, Jordan pointed out that the firm conducted work for the 2020 Biden-Harris campaign, receiving just over $2 million in a one-month period. These financial details are being used to argue that there may be a potential financial benefit to Loren Merchan and Authentic Campaigns from the prosecution and conviction of Trump.

Nellis, for his part, has publicly responded to the subpoena on social media platform X, characterizing it as an "abuse of power" and indicating that he is reviewing the document with his legal team. He vehemently denied the allegations against his company, calling them "completely false and purely politically motivated."

Legal And Ethical Considerations

New York's Advisory Committee on Judicial Ethics determined last year that the independent political activities of a judge's relative are not "a reasonable basis" to question a judge's impartiality. This ruling suggests that the mere fact of Loren Merchan's employment with Authentic Campaigns may not be sufficient grounds for Judge Merchan's recusal.

However, Jordan's subpoena indicates that he and his committee believe there may be more to the story. By demanding a sworn affidavit confirming no communication between Authentic Campaigns and Judge Merchan, Jordan is seeking to either uncover any improper interactions or definitively rule them out.

The subpoena has set a deadline of September 13 for Nellis to comply, adding urgency to the situation given that Judge Merchan is scheduled to sentence Trump on September 18.
