New York State Appeals Court Affirms Pause on Dissolution of Trump Organization

 December 8, 2023

Donald Trump just got some very positive news regarding the fraud case in New York that New York Attorney General Letitia James brought.

The court affirmed the pause of the dissolution of the Trump Organization that Judge Engoron ordered.

Talking Points…

  • Judge Engoron ruling
  • Order put on pause
  • Analysis

Pre-trial Ruling by Judge Engoron

Before the fraud trial started, Judge Engoron made a partial summary judgment that Trump had committed fraud.

It was a stunning ruling, taking everyone by surprise, including most legal experts.

Engoron ordered the dissolution of the Trump organization and stripped the Trump family of some of its properties.

Trump's legal team immediately appealed the ruling.

Appellate Court Pauses the Ruling

After the appeal was filed, the New York Appellate Division temporarily halted the order in October.

On Thursday, that pause was upheld until the fraud trial was completed. With Trump expected to take the stand on Monday, the trial is expected to be wrapped up in about a week, which is when Engoron will make his final ruling in the case.

After the ruling was made, Trump stated:

"The appellate division, New York State, just gave us a very good ruling. Appreciate it. I think the country appreciates it.

"Businesses are watching this case. No business will move back into New York. No business will, frankly, stay in New York. A lot of businesses are talking about leaving New York."

Analysis

So, we all know how Engoron is going to rule, but I would not put too much weight on his ruling.

This move by the appellate court more or less says that Engoron was wrong, and I have always believed that Trump would win this case on appeal.

Most of this case depends on the valuations of Trump properties, which just seem to be off in terms of the actual value of the properties.

For instance, James' office had a valuation for Mar-a-Lago for less than $30 million, yet there are properties in the same county that are one-tenth the size of Mar-a-Lago that are going for $60 million right now on realtor sites.

During this trial, both sides had expert witnesses that, in my opinion, were very weak, but there is no denying the actual numbers here.

Once Engoron issues his verdict, I believe Trump will file an immediate appeal, the dissolution of his company will be halted, and eventually, I think Trump will win this case, even if he has to take it to the Supreme Court.
