New York Judge Rejects Trump's Plea To Postpone Sentencing Before Inauguration

 January 6, 2025

Judge Juan Merchan's refusal of President-elect Donald Trump's motion has made headlines today.

Judge Juan Merchan has dismissed President-elect Donald Trump's request to delay his sentencing in the New York v. Trump case, due on January 10, just before his inauguration, Fox News reported.

President-elect Donald Trump's attorneys requested the postponement earlier on Monday, arguing that the court should delay the sentencing based on Supreme Court decisions and other legal justifications. However, the Manhattan District Attorney's office contended that the court should proceed with the sentencing as scheduled.

Scheduled Sentencing Ahead of Presidential Inauguration

Donald Trump is set to become the 47th president of the United States on January 20, 2025, creating a rare scenario in which a president-elect faces sentencing just days before taking office. The court will sentence him on January 10, 2025, at 9:30 a.m.

Amidst this legal battle, Steven Cheung, Donald Trump's spokesperson and incoming White House communications director, has called the proceedings a "witch hunt" and argued that the court should dismiss the charges entirely.

Trump himself attended the trial physically on April 22, 2024, in New York City. Throughout, he has maintained his innocence and characterized the legal actions as politically motivated to hurt his electoral chances.

Judge Declines Imprisonment, Issues Unconditional Discharge

Despite the controversial backdrop of the trial, Judge Juan Merchan declared his intention to issue an "unconditional discharge" instead of imprisonment for Trump. This decision comes even though Trump was convicted in May on 34 counts of falsifying business records, related to a $130,000 payment to Stormy Daniels before the 2016 elections.

Trump purportedly made the payment to suppress Daniels' allegations of a past affair, an accusation he vehemently denies. The case has stirred significant public and media attention due to its timing and context involving the incoming president.

Reactions to the judge's decision have poured in from various quarters. Steven Cheung articulated the sentiment of Trump's camp in a recent statement:

Today, President Trump’s legal team moved to stop the unlawful sentencing in the Manhattan D.A.'s Witch Hunt. The Supreme Court's historic decision on Immunity, the state constitution of New York, and other established legal precedent mandate that this meritless hoax be immediately dismissed," said Steven Cheung, Trump’s spokesperson and incoming White House communications director.

Trump also voiced his criticisms of the New York judicial system in a post on Truth Social, where he claimed that political bias skewed the legal processes against him.

Trump's Vocal Critique of the Legal Proceedings

Virtually every legal scholar and pundit says THERE IS NO (ZERO!) CASE AGAINST ME. The Judge fabricated the facts, and the law, no different than the other New York Judicial and Prosecutorial Witch Hunts. That’s why businesses are fleeing New York, taking with them millions of jobs, and BILLIONS OF DOLLARS IN TAXES. The legal system is broken, and businesses can’t take a chance in getting caught up in this quicksand. IT’S ALL RIGGED, in this case against a political opponent, ME!!!

The complexity of this case, paired with its timing relative to Trump's upcoming inauguration, presents a legal and political scenario of considerable import. As the date for the sentencing approaches, all eyes will be on how these proceedings impact the political landscape and Trump's commencement of his presidential term.

This legal drama unfolds as Trump prepares to lead the nation, raising questions about the balance of legal accountability and political leadership. As the days count down to both the sentencing and the inauguration, the nation watches closely, poised for the outcomes that will follow.
