Nevada's Democrats Aim to Block RFK Jr. and Green Party from Ballot

An escalating legal battle is unfolding in Nevada as the state's Democratic Party takes steps to prevent Robert F. Kennedy, Jr. and the Green Party from appearing on the election ballot this November.

Fox News reported that the Nevada Democratic Party is challenging the eligibility of independent presidential candidate Robert F. Kennedy, Jr. and the signatures accrued by the Green Party to secure their place in the upcoming election.

These legal challenges highlight profound concerns within the Democratic Party. They are reminiscent of the 2016 election’s controversies, where votes siphoned off to Jill Stein of the Green Party, surpassing the deficit by which Hillary Clinton lost certain key states. These historical worries are driving the current push against third-party involvement.

Challenging the Ballot in Nevada

The state party’s legal contention chiefly revolves around the legitimacy of the 15,000 validated signatures that the Green Party submitted to qualify for the ballot, as confirmed by the Nevada secretary of state. Allegations by the Democrats suggest that these signatures may not adhere to state law requirements.

Further complicating matters is the claim against Kennedy, denoting that his affiliations with different political parties across various states violate Nevada’s regulations that independence candidates should not be registered with any party.

Paul Rossi, serving as campaign counsel, argues vehemently against the state's accusations and contends for the protection of these signatures under constitutional rights. He stated:

The court must prohibit what was either rank incompetence or partisan political gamesmanship by the secretary from invalidating petition signatures afforded the highest First Amendment protection by the United States Supreme Court.

RFK Jr.'s Campaign in Legal Strife

Adding to the complexity, Kennedy’s campaign launched a counter-lawsuit against the Nevada secretary of state. The lawsuit criticizes the prerequisite that candidates declare a running mate before collecting signatures, labeling it unconstitutional under the First and 14th Amendments.

Robert F. Kennedy, Jr.'s views on the situation are stern, equating these legal hurdles to a broader national issue. "Our country is going down a dark road if we start conducting elections in the court," he asserted, reflecting his disapproval of the legal barriers being erected.

Party Responses To the Legal Challenges

Hillary Barnett, Executive Director of the Nevada Democratic Party, defended the legal actions, emphasizing the adherence to state laws. "We filed this challenge to uphold our rights to scrutinize the petitions as allowed by Nevada state law," said Barnett, underscoring a procedural rather than ideological motivation for their challenge.

The Green Party of the United States criticized the lawsuit as not only superfluous but also as a tactic to undercut third-party influence, which they argue represents essential political alternatives. The Green Party stated:

[T]here will be a choice in November that stands against war, genocide and climate catastrophe and for national health care, workers' rights and the funding of an eco-socialist Green New Deal to address the current climate crisis.

This statement from the Green Party encapsulates their broader platform and their perspective on the ongoing legal disputes as a form of voter suppression, accusing the Democrats of alienating working-class voters.

Nevada Secretary of State Cisco Aguilar has maintained a neutral stance, asserting that Nevada respects the rights of third-party candidates to run for office as long as they adhere to the established legal standards.

With multiple lawsuits now pending, the Nevada judicial system is at the center of a significant electoral controversy. This scenario underscores the ongoing tension between established political parties and emerging or independent candidates seeking to broaden the democratic space in U.S. elections.
