Minnesota Appeals Court Overturns Young Adult Firearm Carry Restriction

 September 28, 2024

A significant legal decision has been reached regarding Minnesota's firearm laws.

According to The Truth About Guns, the Eighth Circuit Court of Appeals has abolished Minnesota's prohibition on 18- to 20-year-olds carrying firearms, declaring the age restrictions unconstitutional.

Judicial Review Favors Second Amendment Interpretation

The court's verdict, mandated on September 20, 2024, terminates the state's previous legal stance that barred young adults from the right to carry firearms. This ruling is the culmination of efforts by the Minnesota Gun Owners Caucus, along with the Second Amendment Foundation (SAF) and individual litigants who contested the restrictions as a violation of their constitutional rights.

Litigants Kristin Worth, Austin Dye, and Axel Anderson, supported legally by the Firearms Policy Coalition (FPC), initiated this significant challenge. The trio argued that their fundamental right to bear arms was impinged upon by the state's existing laws.

Sequential Legal Insights and Decisions

In an initial favorable verdict from April 2023, U.S. District Court Judge Katherine Menendez sided with the plaintiffs. However, the actual enactment of this ruling was halted pending an appeal, illustrating the contentious nature of the legal debate.

This pause was sustained until a three-judge panel of the Eighth Circuit, in July 2023, unanimously upheld Judge Menendez's decision, reinforcing the assertion that the Second Amendment does not prescribe age-based limitations. Circuit Court Judge William Benton notably affirmed this view, underscoring the constitutional foundation of the ruling.

Judge William Benton highlighted the non-age-specific language of the Second Amendment, articulating, "In other words, the Founders considered age and knew how to set age requirements but placed no such restrictions on rights, including those protected by the Second Amendment."

Continued Legal Developments and Public Reactions

Following the appeals court's definitive stance, the state of Minnesota was presented with limited options: to either revise its laws to align with this interpretation or to escalate the matter to the U.S. Supreme Court for a potential review. The state's subsequent move remains ambiguous, as the Attorney General's office has not yet disclosed any intention to continue litigation.

The Firearms Policy Coalition aired their satisfaction with the decision on their social platforms, marking a definitive victory for pro-Second Amendment advocacies. The group declared the previous ban essentially null and void, projecting a clear win for proponents of broader firearm rights.

In other words, the Founders considered age and knew how to set age requirements but placed no such restrictions on rights, including those protected by the Second Amendment.

Despite the possible escalation of this legal discourse to the highest court in the country, as of the latest updates, the celebratory statements from right-bearing organizations suggest a temporary resolution in their favor.

The legal journey concerning the age limit imposed on firearm carrying in Minnesota has been marked by several critical milestones: Beginning with the district court's ruling in favor of the plaintiffs in April 2023, a unanimous affirmation by the Eighth Circuit panel in July, and the denial of a rehearing in August. The circuit's formal mandate last September underscores a pivotal moment in this ongoing constitutional dialogue.

With the court's decision, Minnesota must now reconsider its legal boundaries concerning gun rights for young adults, ensuring they align with the federal constitutional standards as interpreted by the court.

This resolution not only reflects a significant adjustment in state policy but also sets a notable precedent for similar legal contests across the nation.
