Los Angeles DA caught in legal battle over Menendez brothers' resentencing

A heated dispute over the resentencing of Erik and Lyle Menendez has erupted within the Los Angeles District Attorney's office, pitting prosecutors against their superiors.

According to Daily Mail, county prosecutors Brock Lunsford and Nancy Theberge plan to sue District Attorney Nathan Hochman and Deputy John Lewin for retaliation, defamation, and discrimination after clashing over the brothers' case.

The conflict stems from Lunsford and Theberge's recommendation to free the Menendez brothers from prison, which contradicted their superiors' stance to keep them incarcerated.

The brothers, now in their 50s, were convicted of murdering their parents, Jose and Kitty, in their Beverly Hills home in 1989.

Career retaliation follows prosecutors support for Menendez release

Following his appointment as District Attorney in November, Hochman took swift action against the dissenting prosecutors. Lunsford, a 25-year veteran of the office, was demoted to a calendar deputy position. Theberge was reassigned to another public defender's office despite receiving an exemplary performance review the day before.

Their attorney, Justin Shegerian, defended their position, explaining their actions were based on legal interpretation. The prosecutors believed the brothers' continued imprisonment no longer served justice's interests.

The situation escalated when Deputy District Attorney John Lewin allegedly made defamatory statements on social media about Theberge's professional integrity. Lunsford claims Lewin called him a "quisling," which he interpreted as being likened to a Nazi collaborator.

Netflix documentary revives debate about brothers abuse claims

The case gained renewed attention through a Netflix documentary highlighting previously unexamined allegations about Jose Menendez's sexual abuse of his sons. During their original trial, the brothers' claims of abuse were not allowed as evidence before their conviction for murder with special circumstances.

The resentencing hearing, initially scheduled for January 30, was pushed to March 20 due to the Los Angeles wildfires disrupting preparations. If successful, the hearing could make the brothers eligible for parole, an option unavailable under their current sentences.

Former District Attorney George Gascon recommended the resentencing in October 2024, a move Hochman criticized as politically motivated during his campaign against Gascon. The new district attorney has announced plans to review each brother's case separately.

Brothers future hinges on March hearing outcome

District Attorney Hochman explained his approach during a December interview:

While they're called the "Menendez brothers case," there's an Erik Menendez case and Lyle Menendez case. So we will look at each case separately, which is the way they actually should be handled.

Two deputy district attorneys filed a 57-page document supporting the brothers' rehabilitation in October. The filing emphasized evolving perspectives on criminal justice:

We now understand that public safety is not best achieved through overly harsh punishments that ignore rehabilitation.

Divided Los Angeles prosecutors await resolution in Brothers case

The Los Angeles District Attorney's office remains deeply divided over the fate of Erik and Lyle Menendez as their March 20 resentencing hearing approaches. The internal conflict has led to career repercussions for prosecutors who supported the brothers' release and spawned potential legal action against District Attorney Nathan Hochman and his deputy. The hearing's outcome could potentially grant parole eligibility to the brothers, who have spent over three decades in prison for their parents' murders.
