A federal judge intervenes in a privacy battle between government employees and billionaire Elon Musk's newly established Department of Government Efficiency.

According to AP News, U.S. District Judge Deborah Boardman issued a temporary restraining order preventing the Department of Education and Office of Personnel Management from sharing sensitive personal information with DOGE representatives, citing potential Privacy Act violations.

The ruling comes after several unions and organizations representing federal employees filed a lawsuit challenging the unauthorized access to private data. Judge Boardman, a Biden nominee, emphasized that while the order doesn't impede President Trump's administrative policies, it safeguards individuals' personal information from unnecessary disclosure.

Federal workers unite against privacy breach

The lawsuit's plaintiffs, including the American Federation of Teachers, National Active and Retired Federal Employees Association, and International Association of Machinists and Aerospace Workers, sought protection against the release of sensitive data.

The information in question encompasses bank account details, Social Security numbers, birth dates, and residential addresses of federal employees.

AFT president Randi Weingarten expressed strong support for the judge's decision, stating:

We brought this case to uphold people's privacy, because when people give their financial and other personal information to the federal government — namely to secure financial aid for their kids to go to college, or to get a student loan — they expect that data to be protected and used for the reasons it was intended, not appropriated for other means.

Judge Boardman determined that the ongoing unauthorized disclosure would cause irreparable harm that monetary compensation couldn't address. The ruling specifically prevents DOGE affiliates from accessing personal information when they lack a legitimate need.

DOGE cuts impact educational assessment programs

The Department of Government Efficiency, under Musk's leadership, has already implemented significant changes within federal agencies. The organization has terminated Education Department contracts valued at hundreds of millions of dollars, affecting various educational programs.

One notable casualty is the Long-Term Trend Assessment, which evaluates reading and math abilities of 17-year-old students. Department spokesperson Madison Biedermann confirmed the cancellation of this national test, though main NAEP assessments for other grade levels will continue.

The testing program, established in the 1970s, has historically provided valuable data on student progress. Its discontinuation will particularly impact the ability to track educational outcomes for students affected by the pandemic.

Current developments and future implications

The legal confrontation between federal workers and DOGE intensified when Musk demanded employees justify their accomplishments or face termination. This action prompted additional legal challenges, with workers' attorneys filing a lawsuit in California claiming violation of employment laws.

Trump's administration defends Musk's aggressive approach as necessary for eliminating government inefficiency and misuse of resources. However, the temporary restraining order represents a significant setback for DOGE's information-gathering capabilities and may influence future reform efforts.

The battle between privacy advocates and government efficiency proponents continues as federal employees await further legal developments. Judge Boardman's ruling establishes an important precedent for protecting personal data while allowing administrative reforms to proceed within legal boundaries.
