A federal judge has dropped a hammer on the Justice Department, demanding transparency in the prosecution of Salvadoran migrant Kilmar Abrego Garcia.

The order, issued by U.S. Judge Waverly Crenshaw earlier this month and made public on Tuesday, mandates the Trump administration to hand over documents tied to the decision to investigate and charge Abrego Garcia for actions linked to a 2022 traffic stop, Fox News reported.

Further, Crenshaw highlighted, “Indeed, at the time of Abrego’s arrest, Blanche linked Abrego’s criminal charges to his successful civil lawsuit in Maryland.” Such a connection raises red flags about whether personal grudges or political posturing drove the case, not evidence.

Abrego Garcia’s saga began nearly 11 months ago with his arrest and deportation to El Salvador, despite a 2019 withholding of removal order protecting him. This violation of prior legal safeguards adds fuel to questions about the administration’s tactics.

In March, Trump invoked a 1798 wartime immigration law to deport 252 Venezuelan migrants, allegedly tied to a violent gang, to the same CECOT facility. Abrego Garcia’s inclusion in such sweeping actions hints at a broader policy of hardline enforcement that may overlook individual rights.

The Justice Department has fought tooth and nail against releasing internal records, citing attorney-client and work-product privileges. Their resistance only deepens suspicion that something doesn’t add up in how this prosecution came to be.
