Federal judge blocks Trump transgender military order sparks controversy

 March 20, 2025

A federal judge with extensive ties to Democratic activism has issued a significant ruling against President Donald Trump's recent executive order on transgender military service.

According to Fox News, U.S. District Judge Ana C. Reyes, who previously volunteered for Joe Biden's 2020 campaign and has donated over $38,000 to Democratic causes since 2008, issued a preliminary injunction preventing the Pentagon from implementing Trump's January 27 executive order that would have changed transgender military service guidelines.

The ruling marks a significant setback for the Trump administration's efforts to modify military policies regarding transgender service members. Judge Reyes, who made history as D.C.'s first openly gay federal judge, questioned the administration extensively about whether the order constituted a "transgender ban" and challenged their position on gender identity.

Judge's Democratic connections raise questions

Judge Reyes' political activities and donations have drawn attention following her ruling on the controversial executive order. Her financial contributions include support for ActBlue, Senator Jon Ossoff's campaign, and maximum allowable donations to Biden's 2020 presidential campaign.

The Biden appointee has also regularly contributed to Defeat By Tweet, a Democratic super PAC supporting the Justice Fund. This organization focuses on raising money for liberal groups in swing states and has connections to initiatives aligned with defunding the police movement.

Before her appointment to the federal bench in February 2023, Reyes established herself as an advocate for immigration rights and progressive causes. She spent time working with the Feminist Majority Foundation and participated in discussions addressing microaggressions and diversity initiatives.

Complex legal battle over military policy

Trump's executive order directed the Defense Department to update its guidance on "trans-identifying medical standards for military service" and remove any existing guidance deemed inconsistent with military readiness. The order emphasized that expressing gender identity different from biological sex could not meet military service requirements.

In her 79-page ruling blocking the order, Judge Reyes cited an unusual source to support her position. She referenced Lin-Manuel Miranda's musical "Hamilton" in her footnotes, drawing parallels between women's voting rights and transgender service members' role in protecting constitutional rights.

The ruling has sparked an immediate response from the Pentagon and Trump administration supporters. Critics argue that the decision represents judicial overreach, while supporters praise it as a necessary protection for transgender service members' rights.

Reyes previous rulings show mixed stance

Despite her progressive background, Judge Reyes has demonstrated independence in past cases involving Trump. She previously criticized Biden's Justice Department when its employees failed to appear for depositions related to Trump impeachment proceedings.

The judge also took a strong stance against the unauthorized release of Trump's tax returns, characterizing it as an attack on constitutional democracy. Additionally, she has shown frustration with legal procedures in cases involving former Trump administration officials.

Her measured approach in these instances has led some observers to argue that her ruling on the transgender military order stems from legal interpretation rather than political bias. However, others point to her extensive Democratic connections as potential influences on her decision-making.

Moving forward amid legal challenges

The preliminary injunction against Trump's executive order represents another chapter in the ongoing debate over transgender military service policies. Judge Ana C. Reyes, despite her significant Democratic ties and progressive activism history, has emerged as a key figure in shaping military policy through judicial review. The Pentagon plans to appeal the ruling while the Trump administration considers additional legal options to advance its military policy objectives. The case highlights the complex intersection of presidential authority, judicial oversight, and evolving military personnel policies in contemporary America.
