The Trump administration is actively moving to decrease the number of federal employees, impacting several at the Environmental Protection Agency.
According to Fox Business, the administration's initiative involves probationary terminations and a separate buyout option for other federal workers.
A recent notice from the Environmental Protection Agency has conveyed unsettling news to its workforce. Approximately 1,100 employees received an email this past Wednesday, signaling possible job termination for those in probationary or trial phases, under policies aimed at slimming down the federal workforce.
The email outlined that under the regulations of 5 CFR § 315.804, the agency can terminate the employment of workers without prior warning if they are still within their probationary or trial period. It advised affected workers on how to respond to their potential job loss, particularly if they believe they're entitled to appeal based on any former civilian or veteran status they hold.
EPA's correspondence emphasized the strict and immediate nature of these terminations. The agency explained, "The process for probationary removal is that you receive a notice of termination, and your employment is ended immediately." This procedure underscores the quick and decisive actions being taken under this legislative framework.
In the same document, the EPA clarified the conditions under which terminated employees could challenge their dismissal. "Whether or not EPA employees have a right to appeal their removal will depend on whether you meet the definition of an 'employee' under the law… and whether you meet the requirements of any OPM regulation that grants appeal rights," the agency detailed.
Concurrently, the Trump administration has initiated a buyout program for eligible federal employees. Announced by the Office of Personnel Management just a day before EPA’s email, this buyout extends from January 28 to February 6, 2025, furnishing participants peace to resign voluntarily with full benefits and final pay.
Here is the EPA's statement explaining the termination process:
"As a probationary/trial employee, the agency has the right to immediately terminate you pursuant to 5 CFR § 315.804. Confirming that one or more of these categories applies to you is not determinative of your probationary/trial period status. Each employee's status will be determined individually."
The buyout offer includes a range of attractive provisions. Employees choosing to resign this way retain all pay and benefits and can forego in-person work obligations until September 30, 2025. They also accumulate leave and are permitted to pursue secondary employment, though certain categories of federal employees are excluded from this program, including those in the military, national security, immigration enforcement, and specific other agency-excluded positions.
The step towards workforce reduction and cost efficiency is being enforced under the directive of Elon Musk’s Department of Government Efficiency.
