Democrats are trying to put forth the argument that Donald Trump can be disqualified from this election per the 14th Amendment, Section 3, reported Fox News.
That is just false, period.
It just goes to show the level of deceit among our elected representatives, and it was also something that was called out by a former prosecutor who worked the Clinton case.
Section 3 states:
"No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."
Yes, Trump has been accused of insurrection, but he has not been convicted, so the idea that they can disqualify him from the election without a proper trial is completely ludicrous.
Now if Trump is found guilty in the January 6 case or the classified documents case, well, that is another subject entirely, but we still have to have those cases play out before such action could take place.
That is not what Democrats are doing, however.
For instance, Rep. Jamie Raskin (D-MD) stated that the Amendment presents a "clear and unequivocal statement" on Trump's "disqualif[ication]."
Well, no, it does not. If opinion was all that mattered, then Joe Biden would have already been removed from office due to his "alleged" ties to Hunter Biden's business interests and participating in those business activities while still a sitting vice president.
Sol Wisenberg, the former prosecutor in the Clinton scandals, who knows far more about the law than I, backed up my premise.
He stated, "The punishment, in addition to the criminal fine is that you cannot ever hold office again. So it's been done.
"The idea that you would have some state official, a partisanly-elected state official, disqualify Trump without any kind of due process at all, I think is not going to fly."
This is a dangerous path that Democrats are taking by removing due process before administering such a penalty.
