Biden's Veto Sparks Federal Judiciary Backlash Over New Judgeships

President Joe Biden faces mounting criticism from federal court leaders following his decisive action on a bipartisan judicial expansion bill.

According to the Washington Examiner, Biden's veto of the JUDGES Act, which would have created 66 new federal judgeships across multiple states to address increasing caseloads, has drawn sharp rebuke from judiciary officials and lawmakers.

The legislation, which passed unanimously in the Senate this August and secured House approval with a 236-173 vote on December 12, proposed adding 63 permanent and three temporary judicial seats across 25 federal district courts in 13 states. This expansion would have significantly impacted states, including California, Florida, and Texas, adding to the current roster of approximately 865 active federal judgeships.

Federal Court Leaders Express Deep Disappointment With Presidential Decision

U.S. District Judge Robert Conrad, who directs the Administrative Office of the U.S. Courts, took a strong stance against Biden's action in a December 16 letter. Conrad, appointed during George W. Bush's presidency, highlighted the administration's failure to support the judiciary's needs.

Chief U.S. District Judge Randy Crane of the Southern District of Texas, whose district stood to gain four additional judgeships, emphasized how the veto would impact court efficiency. The growing caseloads and increasing backlogs continue to strain the federal judiciary system.

University of Richmond Law professor Carl Tobias noted this legislation's historic significance. Compared to similar proposals since 1990, when the federal judiciary last expanded its ranks, this one came closest to passing.

The timing of the bill's passage, following Republican President-elect Donald Trump's victory on November 5, created additional complications. House Democrats, including Rep. Jerrold Nadler, accused Republican colleagues of departing from their commitment to maintain nonpartisan handling of the legislation.

Judge Conrad specifically addressed Biden's departure from historical precedent, stating:

The president's veto will contribute to the pattern of growing caseloads and increasing backlogs that hurt litigants and weaken public confidence in our courts. The President's veto is contrary to the actions of Senator Biden who helped pass many of those bills.

Democratic Senator Chris Coons expressed his disappointment with the veto's impact on both his state and federal judges nationwide. The decision particularly affected those grappling with mounting caseloads across the country.

Legal experts suggest the possibility of reviving similar legislation under the incoming Trump administration. However, Tobias expressed skepticism about securing necessary votes without significant compromises.
