With the momentum now gone to replace Joe Biden, the Democrat Party appears ready to try something desperate to lure in voters for Joe Biden.
Reports broke on Tuesday that will now include Joe Biden making a big move against the Supreme Court.
Talking Points…
- Democrat's relentless attacks against Supreme Court
- Biden making his move
- Analysis
Over the last four years, Democrats have been relentlessly attacking the Supreme Court. Justice Clarence Thomas has been a forever target of the Democrats, especially after he failed to report trips and gifts from someone he considers a friend, and, therefore, did not think he needed to report them. After he did report them, the Democrats went after him with everything they have.
Justice Alito has also been attacked over the last year over flags flying at his primary residence and vacation home. There has been far too much made about these flags, especially the one flying over his vacation home. Anyone who has ever lived in these communities knows how big a role flags play within the community itself. This was truly much-ado about nothing.
But this is not a recent phenomenon, as the left has continually attacked the court. Jonathan Turley wrote an exceptional piece on this very subject in The Hill in 2020 that I would highly encourage everyone to read when you have a chance. He discussed not only the attacks but also how the media has ignored these attacks. He starts the piece by breaking down the media's reaction to Senator Schumer's (D-N.Y.) attack, which was excused when Schumer said that New Yorkers use "strong language." Turley wrote:
“The problem is that this the latest in a pattern of Democratic leaders attacking and threatening jurists if they rule the ‘wrong’ way in certain cases. Although Senate Minority Whip Richard Durbin advised the public ‘not to dwell’ on the comments by Schumer, there is much more to dwell on than just this incident.
“Indeed, Democratic senators, including Durbin, have made threats against the Supreme Court and the judiciary."
A report broke late Tuesday that Biden would announce his support for some significant changes to the Supreme Court. This is a posturing play because the changes Biden wants will never get through the House or Senate. It is nothing more than Biden trying to score points with the far left to save his campaign.
Even though Biden has regularly attacked the Supreme Court, he has been resistant to changes being made. The Washington Post report cited several people who were involved in the planning of Biden's recommendations for the court. According to the report, Biden told donors on a call:
"I’m going to need your help on the Supreme Court, because I’m about to come out — I don’t want to prematurely announce it — but I’m about to come out with a major initiative on limiting the court … I’ve been working with constitutional scholars for the last three months, and I need some help.”
Among the changes that Biden wants to make are term limits for justices and the addition of a constitutional amendment to strike down the presidential immunity ruling. The amendment would eliminate broad immunity for presidents and other officeholders protected under the Constitution. Biden was clearly upset after the immunity ruling, stating:
"This decision today has continued the court’s attack in recent years on a wide range of long-established legal principles in our nation, from gutting voting rights and civil rights to taking away a woman’s right to choose, to today’s decision that undermines the rule of law of this nation.”
Again, this a campaign move for Biden to pacify the far left because he flat-out knows this will never get through Congress. In order to pass an amendment, Biden would need two-thirds of both chambers and he is nowhere near having that number. What this will do, however, is get the far left whipped up into a frenzy again to bring Supreme Court replacement and expansion to be top of mind during the upcoming election. This is nothing more than sheer desperation from a Democrat president who can see the power slipping out of his hands.
