Biden Sends Jab at Trump Over Supreme Court Picks

 May 20, 2024

The latest Joe Biden jab at Donald Trump proves just how biased the media in this country has become.

Had Trump or any Republican made the same comment that Biden made about a Biden pick, there would be national outrage in the media today.

Talking Points…
- Trump SCOTUS picks
- Biden rips possible future SCOTUS picks for Trump
- Analysis

Donald Trump's SCOTUS Choices

When Donald Trump was president, he appointed three Supreme Court justices to the bench: Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett. All three were controversial picks when they were made.

Trump's first pick was Neil Gorsuch, nominated on February 1, 2017, to replace Justice Scalise, who had actually died when Barack Obama was in office. Republicans successfully blocked Obama from getting his guy in there, so Gorsuch was met with nothing but hostility from the Democrats. Gorsuch passed with a vote of 54-45.

The second pick was Brett Kavanaugh, who replaced Justice Kennedy, who was retiring from the court. Dems went after Kavanaugh with everything they had, including sexual assault allegations. Nothing was ever proven to be true, and Kavanaugh passed with a vote of 50-48.

The third justice was Amy Coney Barrett, who replaced the late Justice Ruth Bader Ginsburg. Again, there was controversy because of how late in the term it was and the fact that Republicans had blocked a late-term appointment by Barack Obama. The difference, however, was that the GOP controlled the Senate at the time, sticking to historical precedence on the matter. Barrett was another close vote, passing through with a vote of 52-48.

Biden Rips Possible SCOTUS Picks from Trump

During Joe Biden's term, Democrats have done everything they possibly can to have a conservative justice removed from the bench. They have been relentless against Clarence Thomas, and now they are going after Justice Alito. Democrats are still livid over the fact that Roe v. Wade was overturned, a legally correct decision, by the way, as even the late Justice Ruth Bader Ginsburg had noted that the original opinion was flawed and that it was only a matter of time before the decision was challenged and overturned.

During a recent appearance at the NAACP Freedom Fund Dinner this past Sunday, Biden played off that narrative. Biden, on Trump's SCOTUS picks, stated:

"He brags about getting Roe v Wade overturned. He not only denies reproductive freedom, but worsens the mortality rate for Black moms, who are nearly three times more likely to die from pregnancy complications than a white woman.

"Trump openly encourages voter suppression and election subversion. He and his MAGA extremists gutted affirmative action."

Then Biden went after the actual picks with a veiled slight against them, stating:

"Let me ask you, if he's reelected, who do you think you'll put on a Supreme Court? Do you think he'll put anybody who has a brain? Folks, look: As Dr. King said, give us the ballot. We'll put judges on the bench who will judge justly and do mercy.

"Reelect Kamala and me and a Democratic Congress and we will help the NAACP. We will sign the John Lewis Voting Rights Act, the Freedom to Vote Act and make Roe v Wade the law of the land again."

Analysis

The implication by Biden was that Trump’s other picks had no brains, so let’s just for a second imagine the outrage if Trump or any Republican had made a similar comment about Justice Kentanji Brown Jackson. That aside, this is going to be the big attack that Biden will use against Trump to try to flip the momentum of the minority vote, which is currently heading Trump’s way.

That attack can be neutralized rather easily and should be if Republicans can get on the same page on this. Most people in this country believe there should be three exceptions to whatever limit is set on abortions, those being the health of the mother being at risk, rape, and incest. If Republicans as a whole come out to support that position, possibly even presenting legislation on the issue, this attack is neutralized. If I were running the RNC, that would be my approach, and if I were Trump, I would really start to push this angle to block Biden’s attack.
