According to the Washington Examiner, America First Legal (AFL), a conservative legal organization headed by Stephen Miller, a former adviser in the Trump White House, is behind the complaint.

They argue that DA Alvin Bragg's prosecution of former President Donald Trump was a strategic move favoring Biden's campaign. This alleged act is claimed to have breached the Federal Election Campaign Act (FECA) by acting as an undeclared, excessive campaign contribution.

The allegations focus on a trial where Donald Trump was recently convicted concerning hush money payments. According to the FEC complaint filed by AFL, Bragg’s aggressive pursuit of Trump represents a "coordinated expenditure" that benefitted Biden by potentially tarnishing Trump’s presidential campaign for 2024.

The complaint states that prosecutor Matthew Colangelo, a former high-ranking official in the Biden Justice Department, 's addition to expediting Trump's investigation in December 2022 raises further questions about the impartiality of the legal proceedings.

AFL's filing suggests the appointment may signal deeper political connections and motives behind the prosecution.

The FEC rules dictate that any coordination between a campaign and an external party should be reported as a contribution. AFL alleges that the Biden campaign failed to report such interactions, classifying them as violating federal regulations.

Official Responses to Allegations of Coordination

In counter to these allegations, the Department of Justice (DOJ) addressed the inquiry from the House Judiciary Committee regarding these coordination claims between Bragg’s office and the Biden administration. They confirmed that no evidence was discovered in their detailed search of communications spanning from January 2021 up to the time of Trump’s trial.

The DOJ expressed, "We found none. This is unsurprising," reflecting confidence in the absence of wrongful coordination. These findings, however, have not mitigated the dispute instigated by the AFL's legal challenge.

America First Legal’s vice president, Dan Epstein, emphasized the severity of the allegations and the need for the FEC to conduct a thorough investigation.

Dan Epstein stated, "With the lawfare before the FEC against the candidate and former President Donald Trump, it is important that the FEC take a hard look at the relationship between President Biden, his administration, and his political committees and the New York County DA’s Office’s political prosecution of the former President during a campaign for the year."
