DOJ charges two ex-FBI officials with false statements on Hunter Biden laptop probe

Two former senior FBI officials have been charged with lying to Congress about the bureau’s Hunter Biden laptop work, as defenders call the timing a political stunt ahead of Election Day.

Nikki Floris and Bradley Benavides made their first court appearance Friday morning in Washington, D.C., before Magistrate Judge Zia Faruqui after the Justice Department charged each with one count of making false statements to Congress.

The case centers on their prior testimony that the FBI’s Foreign Influence Task Force had no involvement in investigations tied to Hunter Biden. FBI Director Kash Patel said the record shows otherwise, and the pair will not be held before trial. Their next hearing is set for Tuesday, October 27.

The charges arrived less than two weeks before Election Day and rest on a criminal complaint rather than a grand jury indictment.

The Independent reported that Patel announced the case and pointed to a clear conflict between what the officials told Congress and what the files show.

Patel stated that documentary evidence, contemporaneous communications, and witness accounts contradict their testimony. He added a blunt line on the stakes.

"Lying to Congress by senior FBI officials strikes at the heart of our system. No one is above the law,"

U.S. Attorney Jeanine Pirro struck a similar note in remarks carried by National Review.

"Lying to Congress by anyone strikes at the heart of our democratic system but when senior FBI agents lie to Congress believing they are above the law, it’s time to bring the hammer of justice down on them"

Prosecutors allege the false statements were meant to hide the task force’s real role.

Task force role and the laptop fight

Floris and Benavides had been top intelligence specialists linked to the now-defunct Foreign Influence Task Force. That unit was built to stop foreign actors from unlawfully shaping the 2020 elections. Both told Congress the task force stayed out of Hunter Biden matters.

Justice Department filings paint a different picture. They describe Hunter Biden as “a recurring subject” at the unit’s briefings and in “emails, instant messages, and meetings, including internal discussion of whether information about him was Russian disinformation.”

The Washington Examiner noted that the pair surrendered on arrest warrants and that Patel cited numerous pieces of evidence running against their 2023 testimony.

National Review reporting adds sharper detail on the alleged denials. Floris claimed no involvement in Hunter Biden discussions at the task force. Benavides said he first learned of the laptop from Wikipedia in 2023. Prosecutors say those claims concealed the unit’s engagement and communications about the Hunter Biden investigations and impeded the congressional probe.

Readers tracking bureau accountability have already seen related pressure on FBI personnel, including ex-FBI staff from the Trump documents probe who sued Patel over firings.

The laptop itself landed in public view when The New York Post published its contents in the days before Election Day in 2020. The material allegedly included emails that appeared to show Hunter Biden’s foreign business dealings. Democrats and former intelligence officials raised alarms about possible Russian disinformation. Trump and his allies long argued that the Biden administration and federal law enforcement slow-walked the investigations.

Defense calls the case election-season theater

Lawyers for Floris rejected the charges in strong terms. They framed their client as a longtime public servant now caught in politics.

"Nikki Floris is a patriot. She served our nation as a dedicated FBI intelligence officer for nearly 20 years,"

They continued that the Justice Department had accused her falsely “on the say-so of politicians, not on the facts,” and that the timing was no accident.

"It’s no coincidence the government is filing these nonsense charges now, years later, on the eve of an election."

They called the government’s reasoning “as transparent as they are unjust: to push a false narrative for a shot at political points.” No statement from Benavides or his counsel appeared in the initial reporting.

Floris had already drawn scrutiny from Republican members of Congress and Trump allies over recently declassified emails discussing her intelligence work. The broader backdrop includes years of claims about a so-called “deep state” effort to suppress corruption allegations involving Joe Biden and his family.

Leadership shifts inside the bureau remain a live story for the same audience, as when Andrew Bailey stepped down as FBI co-deputy after a brief run as a possible Patel successor.

Hunter Biden’s legal endgame and prior probes

Hunter Biden was ultimately investigated, charged, and convicted of gun and tax crimes. Joe Biden pardoned him before leaving office. A Justice Department special counsel examined related claims and did not recommend additional charges against Hunter. In a separate track, special counsel David Weiss later charged a government informant for providing false information that alleged bribery inside the Biden family.

Those outcomes sit beside the earlier fight over the laptop’s authenticity and the media’s rush to dismiss it. The new false-statements case does not retry Hunter Biden. It tests whether senior FBI officials told Congress the truth about their own unit’s work.

Coverage of parallel charging actions has already circulated among readers following the same thread, including reports that ex-FBI officials were charged with lying to Congress on the Hunter Biden laptop role.

Unsealed bureau material has also kept the wider Hunter Biden file in view, such as FBI emails showing a Hunter Biden threat text to an L.A. sex worker after the 2020 election.

The complaint route, rather than a grand jury true bill, matters in a capital where grand juries have often been skeptical of politically charged cases. Floris and Benavides remain free pending further proceedings. The October 27 hearing will set the next steps.

Prosecutors’ core claim is straightforward: the officials denied task-force involvement that emails, messages, meetings, and witnesses later confirmed. The defense answer is equally plain: the charges are late, thin, and timed for votes. A court will have to sort which account holds.

Similar charging narratives have drawn steady attention, including earlier accounts of former FBI officials charged with lying to Congress on the Hunter Biden laptop probe.

When senior FBI officials tell Congress one story and the bureau’s own files tell another, the public is entitled to a full accounting, not another round of institutional excuses.
