Judge demands Elon Musk and DOGE disclose downsizing details

A federal directive brings new scrutiny to Elon Musk's role in reshaping the federal government through the Department of Government Efficiency.

According to Fox News, U.S. District Judge Tanya Chutkan has ordered Elon Musk and DOGE to reveal comprehensive plans for government downsizing and provide a complete list of all employees within three weeks.

The ruling comes amid a lawsuit filed by 14 Democratic state attorneys general challenging the constitutionality of Musk's authority within the organization. Judge Chutkan, who was appointed during the Obama administration, will use the requested information to determine whether DOGE's operations should be halted altogether.

Court mandated transparency requirements

The federal judge's order outlines specific documentation requirements that must be produced by DOGE and its temporary organization. These include detailed plans for reducing federal agencies, employee terminations, and modifications to federal contracts and grants.

DOGE must also disclose information about its access to and planned changes for federal databases and data management systems. The order specifically targets materials involving agencies, employees, and contracts that engage with the plaintiff states.

The directive requires DOGE to acknowledge two crucial points about Musk's role. First, that he directs DOGE personnel actions, and second, that the President of the United States is his only supervisor among U.S. officers.

White House involvement under scrutiny

When approached for comment about the judge's order, the White House did not provide an immediate response. This silence comes at a critical moment as questions mount about the extent of executive branch oversight.

Judge Chutkan explained her decision to limit the scope of discovery requests. She emphasized that the burden on the defendants has been minimized through various measures, including a narrow time period for materials and the exclusion of electronic communications.

The ruling specifically exempts President Trump from these requests while extending the defendants' response time. Additionally, it denies the plaintiffs' request to notice depositions.

Constitutional challenges and state intervention

The lawsuit represents a significant challenge to DOGE's authority from state-level officials. Democratic attorneys general argue that the current structure allows Musk to exercise unconstitutional power over federal operations.

According to Judge Chutkan's order:

Plantiffs' Discovery Requests shall be limited to information and materials regarding agencies, employees, contracts, grants, federal funding, legal agreements, databases, or data management systems that involve or engage with Plaintiff States; including entities and institutions operated or funded by Plaintiff States.

The case highlights growing tension between state and federal authorities over the scope and legitimacy of DOGE's operations.
