Tom Homan, the border czar, recently raised questions about the legality of a webinar hosted by Representative Alexandria Ocasio-Cortez's office.
According to the New York Post, Homan has requested the Department of Justice to investigate whether AOC's office crossed legal boundaries by hosting a "Know Your Rights in Case of ICE" webinar that provided migrants with tips on avoiding law enforcement questioning.
The webinar, which aired on the congresswoman's Facebook page, featured guidance from the Immigrant Defense Project. Their expert advised migrants to remain silent during questioning and emphasized that Immigration and Customs Enforcement (ICE) agents rarely possess judicial warrants. The presentation also claimed that ICE officers often employ deceptive tactics to gain entry into private spaces.
During his appearance on CNN's "State of the Union," Homan expressed concerns about the webinar's potential interference with law enforcement operations. The 63-year-old border czar emphasized his extensive experience in immigration law since 1984, suggesting his superior knowledge compared to AOC's understanding of the subject matter.
Homan elaborated on his position regarding the legal implications of the webinar. He stressed that while he wasn't explicitly accusing Ocasio-Cortez of illegal activity, he sought clarity from the Justice Department about the boundaries between providing rights information and impeding law enforcement efforts.
The border czar connected the situation to recent tragic events, referencing the case of Laken Riley's alleged murderer, Jose Ibarra. He argued that stronger cooperation with federal authorities could have prevented such incidents.
The 35-year-old congresswoman did not personally participate in the webinar, though her office organized the event. Her team promoted it as an educational initiative to inform migrants about their legal rights under existing congressional statutes.
Homan shared his perspective with Fox News host Laura Ingraham, revealing that he had contacted the deputy attorney general about the matter. He elaborated on his concerns about law enforcement impediments and suggested potential consequences for AOC.
The border czar told CNN's Dana Bash:
I'm suggesting that I would ask the Department of Justice, where's that line on [law-enforcement] impediment, right? That's a broad statute. You can call it 'know your rights' all you want. I think it's more about how they evade law enforcement not to get arrested, even though there's a federal warrant for your arrest, how they evade that, rather than 'know your rights.'
The Immigrant Defense Project representative presented during the webinar claimed that genuine judicial warrants are rare in ICE operations. They detailed alleged tactics used by ICE officers to gain consent for entry into private spaces.
AOC's office has not responded to requests for comment about the controversy. However, the congresswoman previously dismissed Homan's concerns about the webinar, mocking his outreach to the Department of Justice.
The dispute highlights ongoing tensions between federal immigration enforcement and immigrant rights advocates, reflecting broader national debates about immigration policy and enforcement methods.
The confrontation between White House Border Czar Tom Homan and Representative Alexandria Ocasio-Cortez centers on a Facebook webinar providing immigration rights information to migrants. Homan has requested the Department of Justice to examine whether the presentation crossed legal boundaries by potentially impeding law enforcement efforts, while AOC's office maintains the webinar simply informed migrants about their existing legal rights.
