Pro-Life Group Files IRS Complaint Against Planned Parenthood Over Harris Campaign Space

 January 15, 2025

A Florida chapter of Planned Parenthood faces scrutiny over allegations of improper political involvement in the upcoming presidential election.

According to Fox News, pro-life organization 40 Days for Life has filed an IRS complaint against Planned Parenthood Florida, claiming the organization violated its tax-exempt status by providing workspace to the Harris-Walz presidential campaign.

The complaint, filed in December, presents evidence of what the pro-life group describes as "potentially prohibited political activities" that could jeopardize Planned Parenthood Florida's tax-exempt status. The 42-page document includes photographs showing campaign staffers entering what appears to be the Planned Parenthood office in Sarasota, Florida.

Pro-Life Organization Questions Planned Parenthood Political Activities

40 Days for Life CEO Shawn Carney has highlighted the organization's direct observations of Planned Parenthood's activities through their presence at over 1,700 locations. The group's peaceful vigils outside abortion facilities have enabled them to document various activities they consider problematic.

The complaint specifically mentions promotional materials for "Tim Walz Tuesdays" events, which were distributed at the facility. Carney emphasized that providing space exclusively for Democratic campaign events while not extending the same opportunity to Republicans represents a clear violation of 501(c)(3) regulations.

This recent complaint follows a separate filing by 40 Days for Life regarding Planned Parenthood's mobile abortion services near the Democratic National Convention location. The organization's presence at the DNC coincided with abortion rights becoming a central focus of the Democratic Party's 2024 platform.

Multiple Violations Raise Concerns Over Nonprofit Status

Carney explains that his organization has received confirmation of their previous complaint's receipt and expresses hope for investigation under the Trump administration. The pro-life leader notes this marks the second major violation they've documented:

This is one of the many violations we've seen Planned Parenthood do, because we're physically at these abortion facilities, holding peaceful vigils and offering medical alternatives to abortion. And so because we're out there, you know, at over 1700 locations, we see a lot of things that Planned Parenthood does.

The IRS complaint specifically addresses the distinction between permissible lobbying and prohibited political activities. The document argues that providing office space to a political campaign crosses a clear line and demonstrates explicit political endorsement.

Planned Parenthood Florida has not responded to multiple requests for comment on these allegations. Their silence comes as the organization faces increased scrutiny over its political activities during an election year.

Campaign Space Controversy Intensifies Election Year Tensions

The complaint's timing coincides with a heightened focus on abortion rights in national political discourse. The Democratic National Convention's first day featured extensive discussion of abortion access as a key campaign issue.

The allegations detailed in the complaint suggest a potentially significant breach of nonprofit regulations. Tax-exempt organizations are prohibited from engaging in partisan political activities, including providing material support to political campaigns.

The controversy adds another layer to the ongoing debate over the role of nonprofit organizations in political activities. The outcome of this complaint could have implications for how similar organizations navigate political engagement while maintaining their tax-exempt status.

Current Status Signals Complex Legal Challenge

The IRS complaint against Planned Parenthood Florida alleges the organization improperly provided workspace to the Harris-Walz presidential campaign at their Sarasota location. Filed by the pro-life organization 40 Days for Life in December, the complaint presents photographic evidence and documentation of campaign activities at the facility. As federal authorities review the allegations, the case highlights ongoing tensions between nonprofit regulations and political engagement during election seasons.
