Fulton County DA Rejects Records Request Amid Legal Scrutiny

The Fulton County District Attorney's Office is under scrutiny for refusing to release records related to communications with key figures in the January 6 investigation.

According to Fox News, the office claims such records either do not exist or are exempt from Georgia's open records law.

District Attorney Fani Willis’s office has denied any improper coordination with outgoing special counsel Jack Smith or the House January 6th Committee during her investigation into alleged attempts to overturn the 2020 presidential election. Conservative legal group Judicial Watch filed a lawsuit in March 2024, alleging that the DA’s office failed to provide requested records, prompting legal action and criticism from conservative circles.

Judge Rules Willis Must Respond

On Monday, Fulton County Superior Court Judge Robert McBurney ruled that Willis’s office must produce any relevant documents within five business days. The judge found that the office violated Georgia’s open records law by not adequately addressing Judicial Watch's lawsuit. In its defense, the Fulton County Open Records Department stated that a “diligent search” revealed no records of communications between Willis and Smith.

The department further asserted that any records tied to the House January 6th Committee are legally exempt under Georgia law. Despite these claims, Judicial Watch and Republican lawmakers have raised questions about potential collaboration between Willis and the congressional committee.

House Judiciary Committee members have alleged that Willis sought information from the January 6th Committee, fueling Republican criticism of her actions as politically motivated. These claims have intensified Republican scrutiny of Willis amid ongoing legal challenges surrounding her investigation.

Trump and Allies Challenge Charges

Donald Trump and 18 co-defendants face racketeering charges in Fulton County for alleged efforts to overturn Georgia’s 2020 election results. All defendants, including Trump, have pleaded not guilty. Trump’s attorneys have sought to disqualify Willis from the case, citing conflicts of interest, though these efforts have so far been unsuccessful.

“Records or documents between Willis and the House Select Committee on Jan. 6 are still legally exempt or exempted from disclosure under Georgia law,” said a statement from the department.

Meanwhile, House Judiciary Committee Republicans continue to probe whether Willis coordinated with the January 6th Committee during her investigation. These inquiries have added to the political tension surrounding the legal cases against Trump and his associates.
