Justice Gorsuch Recuses Himself From Environmental Case Over Conflict of Interest Concerns

According to the US News, U.S. Supreme Court Justice Neil Gorsuch has decided to withdraw from a pending case following concerns over a potential conflict of interest linked to a business associate.

Justice Gorsuch, who was previously a legal representative for businessman Philip Anschutz, made his decision known through a brief court announcement. This case involves an environmental impact dispute related to a proposed railway in Utah that aims to transport oil.

The Supreme Court confirmed that Gorsuch would not partake in the deliberations or decision-making due to his past association with Anschutz, whose business holdings could benefit from the railway’s construction.

Calls From Lawmakers Highlight Conflict of Interest

Democratic U.S. Congressman Hank Johnson, alongside 12 other lawmakers, penned a letter on November 21 urging Justice Gorsuch to recuse himself. They argued that his involvement could present a conflict of interest due to his past legal ties with Anschutz whose companies stand to gain from the case outcomes.

The environmental case in question aims to scrutinize the extent of required impact studies under the National Environmental Policy Act of 1970. This legislation mandates comprehensive evaluations to prevent environmental harm from large-scale projects, such as the proposed Uinta Basin railway line.

Judiciary's Integrity At Stake

Congressman Hank Johnson emphasized the importance of judicial integrity in his comments about the situation. He remarked on the need for justices to actively show their independence from influential financial interests.

Johnson further elaborated on the need for a robust system of checks, rather than solely relying on justices' judgments.

This advocacy comes in the wake of the Supreme Court implementing its inaugural code of conduct last year, which aims to guide justices though without any direct enforcement powers.

The decision by Gorsuch to recuse himself demonstrates adherence to these newly adopted ethical standards, despite the lack of compulsory enforcement measures in such situations.

Philip Anschutz's ties to the matter come through his company, the Anschutz Exploration Corporation, which is deeply invested in the regions affected by the proposed railway.
