Biden-Harris Propose Sweeping Supreme Court Reforms

 July 29, 2024

President Joe Biden and Vice President Kamala Harris recently introduced significant reforms aimed at restructuring the U.S. Supreme Court.

According to the New York Post, this comes amid Harris's campaign for the presidency after Biden's endorsement.

The proposals entail introducing an 18-year term limit for Supreme Court justices, enhancing transparency by requiring justices to disclose any gifts they receive, seizing public political activities, and mandating recusal in cases presenting personal conflicts of interest. The legislative proposal also includes a constitutional amendment to overturn a Supreme Court decision regarding presidential immunity.

Reactions to Proposed Supreme Court Changes

The initiative has sparked immediate controversy. Critics, predominantly within the Republican party, argue that these proposed changes are attempts to politicize the judiciary and undermine its independence. House Speaker Mike Johnson vehemently opposed the plan, labeling it "dead on arrival" and detrimental to the judicial system's integrity.

The plan not only focuses on structural changes but also addresses ethical issues sensitized by the actions of conservative justices such as Clarence Thomas and Samuel Alito. It brings ethics to the forefront, aiming to mitigate perceived biases and restore public trust in the judiciary.

Vice President Harris, in the wake of assuming her role as the Democratic presidential nominee, emphasized the significance of the proposed reforms during her speech.

Kamala Harris explained, "President Biden and I are advocating for Congress to implement crucial reforms – these cover imposing term limits for Justices’ tenure, and making Justices comply with binding ethics rules similar to other federal judges."

Strategic Moves in a Presidential Race

This proposal surfaces as Harris kickstarts her campaign with strong advocacies such as abortion rights and ethical governance in the limelight following her endorsement by President Biden. Eight days before the announcement, Biden had concluded his presidential campaign, passing the baton to Harris, who then spotlighted these issues at the LBJ Presidential Library in Austin, Texas.

With abortion rights becoming a poignant focal point in prior elections, the Democrats' current push encapsulates broader issues of rights and governance. President Biden, while stepping down, spoke highly of Harris, underlining her qualities as both a leader and partner during his tenure and highlighting her embodying the "very idea of America."

Kamala Harris further stressed the importance of these reforms for democracy, stating, "These popular reforms will help restore confidence in the Court, strengthen our democracy, and ensure that no one is above the law."

Republicans have questioned the timing and motive behind these reforms. Mike Johnson articulated this stance by stating that this proposal represents the culmination of the Democratic efforts to delegitimize the Supreme Court following disagreements with recent rulings.

President Joe Biden’s effort to overhaul the Supreme Court has been portrayed by Johnson as an effort totilt the balance of power and erode not only the rule of law but also the American people’s faith in our justice system.”

In conclusion, the Biden-Harris proposed Supreme Court reforms seek not only to change how justices are selected and how long they serve but also to address ethical concerns that have bubbled to the surface in recent years. The debate it has ignited reflects deeper national divisions over the interpretation of justice and the role of the Supreme Court in American democracy.
