200,000 Deportation Cases Tossed Because Biden Administration Fails to File Paperwork on Time

After seeing how Biden has blatantly ignored the Supreme Court order regarding student loan debt, it was no surprise to see they are working around the law again to allow more illegal immigrants to remain in this country.

Biden Promised to Increase Numbers

When Joe Biden was on the campaign trail in 2020, he told us exactly what he planned to do regarding immigration. Biden stated that he thought we could double our yearly immigration number and allow an additional two million migrants into the country right away.

Biden has been unable to pass legislation through Congress, so he took it upon himself to figure out a new way to allow that to happen. He created an app that more or less automatically granted asylum to 30,000 migrants every month. Catch and Release were also put back into play, but they were just getting started.

Since Joe Biden took office, reports have estimated that as many as 50% of migrants encountered and apprehended at the border have been released into the country. And if you do the math on the crossings, this puts Biden right where he wanted to be.

Now we are seeing another disturbing trend, where the administration does not file its paperwork on time, which allows the court to toss deportation cases, meaning the migrants are free to stay in the country.

Immigration Cases Tossed by Immigration Court

A report showed up this week via the Transactional Records Access Clearinghouse (TRAC) at Syracuse University. According to that report, the Department of Homeland Security (DHS) failed to submit the required paperwork in time to set court dates (notice to appear or NTA) for some 200,000 illegals, so the court has tossed all of those cases.

The TRAC report stated:

“These large numbers of dismissals and what then happens raise serious concerns.

“Equally troubling is the lack of solid information on what happened to these many immigrants when DHS never rectified its failure by reissuing and filing new NTAs to restart their Court cases.”

This is no oversight because this now seems to be one of Mayorkas’ tools to allow more illegal immigrants to remain in the country. All we need to do is look at the historical data to back this up.

For instance, in 2020, prior to Biden taking office, there were only 6,482 cases that fell into this category. That is still too many if you ask me, but that is nothing like we have seen under Biden. In 2021, Biden’s first year in office, that number rose to 33,802. The combined numbers for 2022 and 2023 are another 148,821 cases, an average number that is 10 times the number of cases missed when Trump was in office.

Analysis

This is a problem on many fronts, especially for people who have legitimate asylum claims. When these cases get tossed, they are blocked from getting their green cards and being able to work. But I would suspect the people doing immigration by the book are not the ones seeing their cases dropped off the books by the Biden administration.

This is about organization and procedure, and the Biden administration has repeatedly proven that it is incapable of being organized or following procedure. Even so, this is just something that is unforgivable and creating an even bigger mess than we already have because of Biden’s loose border policies. Give Mayorkas an inch; he will take a foot. Give him a rope, and he thinks he is a cowboy, and that is exactly what he has done here. Not that we needed it, but this is another reason why Mayorkas must be impeached and removed from his post.
