Democrats love to give free stuff away to illegal immigrants, and back in May, the administration introduced yet another rule to benefit illegals. The rule would provide free health care via the 2012 Deferred Action for Childhood Arrivals (DACA) program. To this point, those individuals had been blocked from Obamacare, but that would no longer be the case under the administration's new rule, which was set to go into effect just days before the 2024 election, offering more than 100,000 illegals access to health insurance. Health and Human Services has made this possible by declaring DACA recipients as "lawfully present" in this country. In presenting the new rule, Biden stated:
"I'm proud of the contributions of Dreamers to our country and committed to providing Dreamers the support they need to succeed. That's why I've previously directed the Department of Homeland Security to take all appropriate actions to 'preserve and fortify' DACA. And that's why today we are taking this historic step to ensure that DACA recipients have the same access to health care through the Affordable Care Act as their neighbors."
Kamala Harris added:
"President Biden and I will continue to do everything in our power to protect DACA, but it is only a temporary solution. Congress must act to ensure Dreamers have the permanent protections they deserve."
Three months later, and only three months before the election, the GOP has finally decided to do something to block the rule from taking effect. A group of 15 states, which Kansas is heading, is now suing the Biden administration to block funding for Biden's new rule. Kansas Attorney General Kris Kobach filed the suit, stating:
"Illegal aliens shouldn't get a free pass into our country.
"They shouldn't receive taxpayer benefits when they arrive, and the Biden-Harris administration shouldn't get a free pass to violate federal law. That's why I am leading a multistate lawsuit to stop this illegal regulation from going into effect."
In addition to Kansas, the other attorneys general who have joined the suit are from Alabama, Idaho, Indiana, Iowa, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, and Virginia. I have to admit, I was shocked not to see Texas and Florida included in the complaint, as both states have aggressively pursued Biden, especially regarding new immigration rules.
I don't understand why it took the GOP so long to act on this, but at least they finally have. My guess is that they wanted to make it an election issue, so they figured they would file down the stretch to ensure it was in the news as people are starting to seriously consider their candidates (early voting starts in about two weeks). Republicans have not had a lot of luck fighting DACA in the courts, so I am not optimistic, but I definitely support this fight.
